Gluely is an AI-powered platform that allows users to generate and edit images and videos using artificial intelligence technology. The Service is provided “as is” and may be modified, updated, or discontinued at any time.

3. User Accounts

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 13 years old to create an account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4. Credits and Subscriptions

The Service operates on a credit-based system. Credits are required to generate content and are consumed based on the type and complexity of generation.

• Subscriptions: Provide recurring credits each billing period. Subscriptions auto-renew unless cancelled before the renewal date.
• Credit Packs: One-time purchases that do not expire.
• Free Credits: May be provided for promotional purposes and may expire.

All purchases are processed through Apple App Store or Google Play Store. Refunds are subject to their respective refund policies.

5. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or offensive content
• Create non-consensual intimate imagery of real people
• Generate content that infringes on intellectual property rights
• Harass, abuse, or harm others
• Generate content depicting minors in inappropriate situations
• Spread misinformation or deceptive media
• Violate any applicable laws or regulations
• Attempt to reverse engineer, hack, or compromise the Service
• Use automated systems to access the Service without permission

We reserve the right to remove content and terminate accounts that violate these terms without refund.

6. Content Ownership

Your Content: You retain ownership of images you upload. By uploading content, you grant us a license to process it for providing the Service.

Generated Content: Subject to these Terms and applicable law, you own the content you generate using paid credits. However, similar content may be independently generated by other users using similar prompts.

Our Content: The Service, including its design, features, and technology, is owned by Gluely and protected by intellectual property laws.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

AI-generated content may contain errors, biases, or unexpected results. You are responsible for reviewing and appropriately using any generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLUELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless Gluely and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable upon termination for cause.

You may delete your account at any time through the app settings.

We may modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
